The main advantages of cross leases were all but removed with the introduction of the Resource Management Act in 1991, when they effectively came to an end. At face value a cross lease looks the same as a proper subdivision, however there are some very important exceptions which anyone who owns a cross lease property should know about. <\/p>\n<ul>\n<li>All owners of cross lease properties own an undivided share (%) in the entire property and they lease an area of land that their house sits on from the other cross lease owner(s).<\/li>\n<li>At the time the cross lease was set up, a survey plan was prepared showing the position of the houses and buildings and that is the land that they lease from the other cross lease owner(s).<\/li>\n<li>If any alterations or additions are made to any of the houses or buildings that change the footprint of land they occupy, your title becomes defective.<\/li>\n<li><!--StartFragment-->\n<div>Carrying out any alterations or additions without obtaining all other cross lease owners written permission is illegal and may invalidate your insurance.<\/div>\n<\/li>\n<li>\n<div>If any alterations or additions have been made, the cross lease needs to be updated, which requires a new survey plan to be prepared and the lease to be updated and signed by all cross lease owners. This can be an expensive and difficult exercise if the other cross lease owners do not want to give their approval.<\/div>\n<!--EndFragment--><!--EndFragment--><\/li>\n<\/ul>\n<p><!--StartFragment--><\/p>\n<p>There has been quite a lot in the press recently about the pitfalls of owning a cross lease. This process is managed by a subdivision application to the Council. As your property already contains a house, the process is usually quite straight forward and cost effective.<\/p>\n<p><!--StartFragment--> <!--EndFragment--><\/p>\n<p><em><strong>NB<\/strong>. This stretches from the Waitakere suburb in the south all the way to Stillwater in the north, a distance of around 32km. As new clients have come on board from these areas, they haven’t realised that we are the complete package and surveying is not all we offer. They have been operating their business out of the same small depot on Nelson Street in Pukekohe for over 30 years and have long-since outgrown this, finding it more and more difficult to navigate the streets of Pukekohe with their large trucks. After an exhaustive and unrewarding search for a block of Business Zoned land to move to, they settled on a block of rural land near Puni. <\/span><\/p>\n<p class=\"Default\"><span style=\"font-family: Calibri, sans-serif; font-size: 11pt;\">In 2015 TSC set about preparing a Resource Consent application to enable Powell Transport to relocate their business to Puni. This was lodged in 2016 and was put through a rigorous Planning enquiry that involved full Public Notification and a hearing. After four years of hard work, we were delighted to receive approval from the Council in May 2019. These range from breeder and rearing sheds to free range poultry sheds associated with independent farm owners and large scale poultry companies. One of these companies is Cobb-Vantress New Zealand who operate a pure line hatchery, breeder and rearing facility in the Waikato region.<\/p>\n<p>TSC have been working with Cobb-Vantress since the site selection stage to produce a world class facility that delivers high quality poultry stock to Asia and the Pacific. TSC managed the resource consent process, civil engineering and surveying works until completion of the project. The 149 hectare farm site now includes 9 rearing sheds, 10 production sheds, a quarantine and sanitation building, a hatchery and a restored wetland.
